Terms of Service

1. Agreement

Welcome to Real Weird World ("we," "us," or "our"). These Terms of Service govern your use of the RealWeirdWorld.com website, the products and services we sell, and the BackCheckers mobile application. By using any of them, you agree to these Terms. If you do not agree, please do not use them.

Our Privacy Policy and Refund Policy are part of these Terms.


2. Eligibility

Purchases. You must be at least 18 years old to make a purchase from us. If you are under 18, you may only make a purchase with the involvement of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for the order.

The BackCheckers app. The app is free and available to users of any age. It requires no account and collects no personal information. If you are under 18, we encourage you to review these Terms with a parent or guardian.


3. What We Sell

We sell physical products, including board games, clothing, and other merchandise; digital products, including games, music, film, and editing content; and related services. Product descriptions, images, availability, and pricing may change at any time without notice. We try to describe our products accurately, but we do not warrant that descriptions or images are error-free.


4. Orders and Payment

Payment is due in full at the time of purchase. We accept the payment methods shown at checkout, processed by Stripe. You agree to provide accurate, current, and complete billing and contact information.

We may refuse, limit, or cancel any order — including orders that appear fraudulent, that exceed reasonable quantities, or that result from a pricing or description error. If we cancel an order you have already paid for, we will refund it in full.


5. Shipping

We currently ship physical products only within the United States, using established carriers such as USPS, UPS, and FedEx. We do not offer international shipping. The carrier and service level for your order are identified in your shipping confirmation.

Delivery times are estimates and are not guaranteed. Once a package is handed to the carrier, delivery is outside our control, and we are not responsible for delays caused by the carrier, by weather, or by an incorrect address you provided. Risk of loss passes to you on delivery to the address you gave us. See our Refund Policy for damaged and undelivered packages.


6. Refunds and Cancellations

Refunds, replacements, and cancellations are governed by our Refund Policy, which forms part of these Terms. In summary: physical products may be refunded or replaced if they arrive damaged or defective, or if they are lost in transit; digital products are final sale.


7. The BackCheckers App New section

License. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the BackCheckers app on devices you own or control, for your own non-commercial use. The app is licensed to you, not sold.

Apple's terms also apply. Your license to use the app is additionally subject to Apple's Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where Apple's agreement conflicts with these Terms in respect of the app, Apple's agreement controls.

Apple's role. These Terms are between you and Real Weird World LLC only. Apple is not a party to them. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claim you have relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the app, and may enforce them against you.

No purchases in the app. The app is free. It contains no in-app purchases and no advertising. Our physical products are sold only through RealWeirdWorld.com, not within the app.

Your content. Team names, game logs, and shared game files you create in the app are yours and are your responsibility. We do not receive, host, moderate, or back up any of it. If you share a game file with another person, you are responsible for what it contains, and you should keep your own backups of anything you want to keep.

Restrictions. You may not reverse engineer, decompile, or disassemble the app except to the extent that restriction is prohibited by law; rent, lease, sell, sublicense, or redistribute it; remove any proprietary notices; or use it in a way that violates applicable law or these Terms.


8. Acceptable Use

When using our website, products, or app, you agree not to:

  • Copy, reproduce, distribute, or use our content without permission

  • Hack, probe, overload, interfere with, or disrupt our website or systems

  • Use our services to violate any law or to infringe anyone's intellectual property rights

  • Attempt to gain unauthorized access to any account, system, or data

  • Misrepresent your identity or submit false order information


9. Intellectual Property

All content associated with Real Weird World — including logos, trademarks, text, images, video, music, game rules, artwork, game design, and software including the BackCheckers app — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use it without our express written permission.

This does not apply to content you create yourself using our products, such as the team names and game records you enter into the app. That content remains yours.


10. Disclaimer of Warranties New section

Our website and the BackCheckers app are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the website or app will be uninterrupted, timely, secure, or error-free, or that any data stored in the app will be preserved. The app stores your game records only on your device. We cannot recover them if your device is lost, damaged, reset, or if the app is deleted.

Some states do not allow the exclusion of certain implied warranties, so some of these exclusions may not apply to you. Nothing here limits any non-waivable warranty rights you have in the physical products you buy from us.


11. Limitation of Liability

To the maximum extent permitted by law, Real Weird World LLC and its members, officers, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of our website, products, services, or app — even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim relating to these Terms or to our products or services will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred U.S. dollars.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.


12. Indemnification New section

You agree to indemnify and hold harmless Real Weird World LLC and its members, officers, and agents from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of our website, products, or app, or your violation of any law or third-party right.


13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.


14. General New section

  • Severability. If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions stay in full effect.

  • Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us regarding their subject matter, and replace any prior understandings.

  • No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.

  • Assignment. You may not assign or transfer these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of our assets.

  • Headings. Section headings are for convenience only and do not affect interpretation.


15. Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page with a revised effective date. Your continued use of our website, products, or app after changes are posted means you accept the updated Terms. The Terms in effect at the time you place an order govern that order.
